Senator Brian Helton, Fayette ( R ), is going to propose legislation to reinstate the death penalty for anyone who commits egregious sexual crimes against children. According to what he proposes, jurors can recommend death, with that sentence going to the WV Supreme Court for review, or they can recommend the sentence of life in prison without the possibility of parole to the judge. If someone is innocent of the charge and is found guilty of the crime they have the appeals process to right the wrong because we can not with hold the greatest punishment for such a crime just because someone may be wrongly accused, Helton believes.
